ARREST WARRANT / AFFIDAVIT: |
On 12/22/2021 at approximately 2217 hours, officers responded to a domestic disturbance at 912 Chickasaw Ave. On scene, officers spoke with both the victim (Ashten Stephenson) and the defendant (Krystal Wallace, OCA: 523923) separately. The victim advised that her and the defendant used to date and that they are now living together.
The victim stated that the defendant had been drinking and acting belligerent. The victim advised that she questioned the defendant about her drinking and the defendant became irate and a verbal dispute occurred. The victim advised that she attempted to remove herself from the situation and went into her bedroom, but the defendant rushed into the room armed with a steak knife in her right hand. The victim advised that the defendant then pointed the knife in her direction and stated, “I am going to kill you.” The victim advised that she feared for her life, ran outside, and called the police. The victim escorted officers inside the residence where a steak knife was located in the kitchen on the counter. The victim advised officers that it was the same knife used by the defendant. Officers took pictures of the knife for documentation and seized the knife, submitting it to property and evidence. Officers spoke with the defendant and read her Miranda, and under Miranda the defendant advised that it was merely a verbal dispute, that nothing violent occurred. Due to the statements made by the victim and due to the victim being in fear for her life, officers had probable cause to prosecute on behalf of the victim. Due to the defendant being charged with aggravated assault, the victim did not qualify for a state citation and was taken to booking without incident. |
