25-year-old Kyler Vance Shular is charged with felony aggravated assault/strangulation and false imprisonment after his ex-girlfriend came over to get her things from their shared apartment, to which she still had a key, and he reportedly became upset, pinned her to the floor, threatened her, then covered her mouth when the screamed. A neighbor heard the commotion and knocked on the door, allowing the victim, Halle Strunk, to escape. Both parties had injuries as she fought back and bit him at least once in self-defense, however, police determined Shular to be the primary aggressor due to the disparity in physical sizes and severity of injuries between the parties. Shular is free on an $8,000 bond.

COMPLAINT:
2022-0009807
ARREST WARRANT / AFFIDAVIT:
On 01/07/2022 at approximately 1900 hours the victim went to her apartment at 3838 Central Pike; Apartment 227, Hermitage, Tennessee. The victim (Ms. Strunk) and the defendant (Mr. Shuler) are former boyfriend and girlfriend and lived together for a period of several months at the Central Pike address. The victim arrived at the apartment with the intention of removing her belongings, as she was moving out.

The victim had a key to the apartment and let herself in. The victim advised that she was given the key by the defendant at an earlier time as she lived at the location. The victim noted that some of her belongings had been disturbed, and questioned the defendant regarding them. An argument ensued regarding the items.

The defendant became angry and grabbed the victim by her shoulders and ordered her to leave. The victim refused to leave and stated that she would be getting her things first. The victim broke away from the defendant and went to the spare bedroom of the apartment where most of her belongings were located. The defendant followed her and continued to demand that she leave. The defendant then grabbed the victim by her arm and wrist and threw her down onto the floor. He then pinned her to the ground and stated, “I’m not going to let you go until you agree to leave.”

The victim became frightened and stated she would leave. The defendant briefly got off of the victim, but then demanded the victim return the key to the apartment. The victim refused to return the key but repeated she would leave. The defendant then got back on top of the victim, who was still catching her breath and had not risen from the floor yet. He grabbed her by the neck and began strangling her with both hands making it difficult for her to breathe.

The victim stated that she was afraid, and bit the defendant on the forearm, causing him to release her neck. She then began screaming for help. The defendant attempted to cover the victim’s mouth violently, resulting in the victim biting her lip badly, causing bleeding and swelling. A next-door neighbor heard the victim yelling and knocked on the door. The defendant got off of the victim to answer the door and the victim then ran out of the apartment.

Officers interviewed the defendant, who stated that he did attempt to escort the victim out of the apartment, but that she began kicking him and he restrained her from doing so. He then stated that the victim bit him while he was restraining her, and he grabbed her by the chin to stop her biting. Officers observed a bite mark on the defendant’s forearm. The victim had multiple injuries, including marks on her neck, arms, head, and the bitten lip. The defendant was determined to be the primary aggressor in the incident, due to the unexplained marks on the victim’s neck, and the severity of her injuries, and the size disparity between the victim and defendant.
