27-year-old tourist Adolfo Monge, from Atlanta, is free on pre-trial release after police say he came into the Comfort Inn on Demonbreun, initially asking to charge his phone. After a confrontation between him and the front desk clerk, he ripped the credit card machine from the front desk and tossed it across the lobby, stating “Make my Day! Do you want to fight me?”. He would eventually leave, then return to stare at the clerk, who called police a second time. He was finally taken into custody and charged with vandalism.

COMPLAINT:
2022-0001638
ARREST WARRANT / AFFIDAVIT:
OFFICERS WERE DISPATCHED TO THE COMFORT INN AT 1501 DEMONBREUN ST FOR A SUBJECT, LATER CONFIRMED TO BE THE DEFENDANT, THAT HAD BROKEN THE CREDIT CARD MACHINE, AN INGENICO ISC TOUCH 480, AT THE HOTEL.

UPON ARRIVAL, OFFICERS MADE CONTACT WITH THE WITNESS WHO WAS AN EMPLOYEE AT THE HOTEL. OFFICERS OBSERVED THE CREDIT CARD MACHINE HAD BEEN RIPPED OFF OF THE FRONT DESK OF THE HOTEL AND THROWN ACROSS THE LOBBY. THE WITNESS SHOWED OFFICERS A PICTURE OF THE DEFENDANT. THE WITNESS STATED THE DEFENDANT HAD INITIALLY JUMPED BEHIND THE COUNTER TO ATTEMPT TO CHARGE HIS CELL PHONE AND WHEN THE DEFENDANT WAS ASKED TO LEAVE FROM BEHIND THE COUNTER STATED, “MAKE MY DAY… DO YOU WANT TO FIGHT ME?”.

THE DEFENDANT THEN LEFT FROM BEHIND THE COUNTER AND WHEN HE WAS REFUSED A ROOM THE DEFENDANT THREW THE CREDIT CARD MACHINE ACROSS THE LOBBY. THE WITNESS STATED THE MACHINE WAS WORTH $300. OFFICERS LEFT TO COMPLETE A REPORT AT THE MIDTOWN PRECINCT AND JUST AS THEY RETURNED TO THE PRECINCT THE WITNESS CALLED TO REPORT THE DEFENDANT HAD RETURNED TO THE LOBBY.

THE WITNESS STATED THE DEFENDANT WAS STARING AT HIM. OFFICERS ARRIVED AT 1501 DEMONBREUN AND THE WITNESS STATED THE DEFENDANT HAD JUST RECENTLY WALKED AWAY. OFFICERS LOCATED THE DEFENDANT A FEW MINUTES LATER AT 17TH AVE S AND BROADWAY WEARING THE EXACT CLOTHING SEEN IN THE ORIGINAL PICTURES OFFICERS WERE SHOWN.

THE DEFENDANT STATED HE HAD BEEN DRINKING AND WAS TRYING TO FIGURE OUT WHERE HE WAS STAYING. OFFICERS TOOK THE DEFENDANT INTO CUSTODY AND TRANSPORTED HIM TO 1501 DEMONBREUN AT APPROXIMATELY 0540 HOURS WHERE THE WITNESS CONFIRMED THE DEFENDANT WAS THE ONE WHO BROKE THE CREDIT CARD MACHINE.

OFFICERS CHOSE CUSTODIAL ARREST DUE TO THE REASONABLE LIKELINESS THAT THE OFFENSE WOULD CONTINUE AS THE DEFENDANT RETURNED TO THE LOCATION. THE WITNESS WAS UNABLE TO LEAVE THE HOTEL DUE TO HIM BEING THE ONLY ONE WHO WAS WORKING BUT STATED HE DID WISH TO PURSUE PROSECUTION.
