Then, Babitt showed officers footage of Filipovich blocking the stairs, grabbing her by her jacket and neck before sitting her down on the couch, hindering her breathing. Babitt said she planned to leave via rideshare, but when she was leaving, Filipovich pushed her from behind, causing Babitt to slip on the ice and hit her head on the concrete. Babitt then canceled the rideshare and told Filipovich that she needed immediate medical attention, so he called the ambulance. However, the call for service made by Filipovich was regarding a fall and not an assault, so the authorities were not alerted at the time. Babitt was transported to Vanderbilt Hospital by NFD and told them she wanted to call the police but was unable because Filipovich was still with her. Filipovich was taken into custody for aggravated assault on February 12th.

Jay was not participating in court proceedings, and Sara’s lawyer last month requested a Nashville Judge to enter a default judgment, granting the divorce according to the terms of their 2008 marriage agreement, which would leave both parties as they came to the marriage, with no additional monies or assets granted to either party upon divorce, and removing either party from any asset claims or distribution upon the death of either party if a divorce occurred.
