DUI: Man found asleep behind wheel 100 yards off Briley Parkway — Gregory Chitwood

37-year-old Gregory Chitwood is charged with driving under the influence after multiple motorists called 911 to report a dark-colored pickup truck was off the roadway on Briley Parkway. Officers canvassed the area, eventually locating the vehicle in a grassy field 100 years away from the road. Chitwood was found asleep behind the wheel of the vehicle, which was still running and still in drive. He admitted to drinking prior to driving. Chitwood blew a 0.141% BAC and was charged with DUI. He is free on pre-trial release.

ARREST WARRANT / AFFIDAVIT:
On 12/23/2021 police received several calls from passerby motorists, each motorist advised that a dark-colored pickup truck was off the roadway near mile marker 16/2 on Briley Parkway Eastbound. Officers canvassed the area and discovered a black Toyota pickup truck some 100 yards off the roadway in a grassy field off Briley Parkway eastbound near mile marker 16/2.

I observed the defendant asleep in the driver seat of the vehicle with the vehicle still in drive, running, with the keys in the ignition. I was able to safely get the defendant out of the vehicle without further incident. Once outside the vehicle, the defendant had an odor of an alcoholic beverage emitting from his person, red bloodshot watery eyes and admitted to consuming alcohol earlier in the night.

The defendant agreed to conduct field sobriety and was transported to 1201 Gallatin pike south where testing was completed on a flat surface. The defendant showed several signs of impairment during HGN, the walk and turn, and the one-leg stand.

The defendant was placed under arrest for the suspicion of driving under the influence. At 0405 I read the defendant his Miranda rights and at 0408 hours the defendant was read Implied consent and consented to provide a breath sample. Once at booking the defendant provided a breath sample of .141% at 0456 hours into a tested and calibrated breathalyzer instrument.

A record check on the defendant revealed no previous convictions for driving under the influence in the state of Tennessee. All the information listed above occurred in Davidson County Tennessee.
