DUI: man found asleep behind wheel near intersection, blows 0.157 BAC — Rudy Mahosky arrested

31-year-old Rudy Mahosky was booked into the Metro Nashville Jail early Tuesday morning after being round asleep behind the wheel of his car near an intersection with the keys in the ignition. Mahosky admitted to having “two drinks within the last hour”, and agreed to field sobriety tests, during which officers say he showed multiple signs of impairment. He consented to a breathalyzer and blew a 0.157 BAC, nearly twice the legal limit in Tennessee. Mahosky was charged with DUI, and is free on pre-trial release.

ARREST WARRANT / AFFIDAVIT:
AT 0319 ON 12/21/2021 OFFICERS WERE DISPATCHED TO THE INTERSECTION OF GEORGE L DAVIS BLVD / DR MARTIN L KING JR BLVD FOR A PERSON SLEEPING IN HIS CAR NEAR THE EXIT RAMP. MEDIC 19 WAS ON THE SCENE PRIOR TO OFFICERS ARRIVING IN WHICH THE DEFENDANT REFUSED MEDICAL ASSISTANCE. MEDICS ADVISED THE DEFENDANT WAS FOUND SLEEPING IN HIS CAR WITH THE KEYS IN THE IGNITION.

ONCE I ARRIVED THE DEFENDANT WAS STANDING ON THE SIDEWALK OF THE INTERSECTION SPEAKING WITH NORTH PRECINCT OFFICERS ARNOLD, AND OFFICER DEMARCE PRIOR TO MY ARRIVAL. OFFICERS IMMEDIATELY NOTICED THE SMELL OF AN ALCOHOLIC BEVERAGE COMING FROM THE DEFENDANT’S PERSON. THE DEFENDANT ALSO HAD BLOODSHOT EYES, SLURRED SPEECH, AND WAS UNSTEADY ON HIS FEET.

WHEN ASKED HOW MANY ALCOHOLIC BEVERAGES HE CONSUMED, HE STATED “TWO DRINKS WITHIN THE LAST HOUR”. THE DEFENDANT WAS TRANSPORTED TO 1100 DR MARTIN LUTHER KING BLVD TO CONDUCT THE SFST’S DUE TO THE FLAT SURFACE WITH ARTIFICIAL LIGHTING. THE DEFENDANT SHOWED MULTIPLE SIGNS OF IMPAIRMENT DURING THE HGN, WALK AND TURN, ONE-LEG STAND.

AFTER BEING READ HIS MIRANDA RIGHTS AT 0437 AND THE IMPLIED CONSENT LAW, THE DEFENDANT AGREED TO SUBMIT TO A BREATH TEST IN WHICH HE BLEW A .157. A RECORD CHECK SHOWED THAT THE DEFENDANT’S DRIVER’S LICENSE IS VALID IN THE STATE OF TENNESSEE. HE WAS IDENTIFIED THROUGH HIS DRIVER’S LICENSE PHOTOGRAPH. THE DEFENDANT HAS NO PRIOR DUI OFFENSES.

THE DEFENDANT WAS ARRESTED DUE TO OBVIOUS SIGNS THAT DEFENDANT WAS IMPAIRED, HE WAS TAKEN INTO CUSTODY AND TRANSPORTED TO BOOKING BECAUSE HIS ACTIONS INDICATED HE IS A DANGER TO HIMSELF AND OTHERS AT LARGE.
