27-year-old Davante Payne had a car accident at the Bell Road and Blue Hole Road intersection on December 22nd. Payne advised officers that he only remembers driving on Bell Road but not hitting another car. He said he was coming from a company party at a bar and had not drunk anything. They smelled alcohol on his breath, and Payne consented to sobriety tests. Payne then performed poorly and was Mirandized. Under Miranda, Payne continued to insist that he did not drink anything.
