DUI: Davante Payne insists he did not drink before driving, blows 0.187% BAC

27-year-old Davante Payne had a car accident at the Bell Road and Blue Hole Road intersection on December 22nd. Payne advised officers that he only remembers driving on Bell Road but not hitting another car. He said he was coming from a company party at a bar and had not drunk anything. They smelled alcohol on his breath, and Payne consented to sobriety tests. Payne then performed poorly and was Mirandized. Under Miranda, Payne continued to insist that he did not drink anything. Officers read Payne implied consent and he consented to a breath test which resulted in 0.187% BAC. Davante Payne was taken into custody for driving under the influence.

Davante J Payne of Riverwood Court in Lavergne, TN, was booked into the Metro Nashville Jail on December 22nd, charged with driving under the influence. A judicial commissioner set his bond at $3,000, and the Davidson County Sheriff’s Office gave him pre-trial release from their facility.
