26-year-old Terrence Bergbower was hanging out of his driver’s side door and slumped over a pile of vomit at the parking lot near Broadway behind Acme Feed and Seed late December 31st. Two concerned citizens noticed this and alerted authorities. They arrived and observed the vehicle was still running. At the same time, Bergbower was found asleep in the driver’s seat, hanging out of the driver’s side door with vomit below him. Officers woke up Bergbower, who advised officers that he was intoxicated and only sitting in the vehicle to stay warm. He consented to sobriety tests, performed poorly, and provided a breath sample, resulting in 0.114% BAC. Bergbower was taken into custody for driving under the influence on January 1st.
